Disposition of Assets

Attorney Charles Nellari helps individuals and families throughout California with their Wills & Trusts and other Estate Planning matters, including tax planning, healthcare directives, and business succession planning. Our office help young professionals starting out in business who have a family to protect, understand the importance of protecting what they are building and protecting themselves and their loved ones with some prudent contingency planning. It is never too early to create an estate plan.

The legal process of distributing the decedent’s assets to heirs and creditors is called probate. If there is a valid will, the personal representative named in the will is responsible for filing the will with the probate court and beginning the probate process.

In the absence of a valid Will, your assets shall be distributed by the State’s statutes, may not the way you would have wanted. We suggest that you take charge how you want your assets are to be distributed.

Charles can advise you on how to minimize estate taxes.

A Power of Attorney is a document that gives another person (the attorney-in-fact) legal authority to make decisions on the grantor’s behalf. It is a helpful document so long as you give proper directions and limit the powers. You do not want someone use the powers inconsistent with your interests.

Law Offices of Charles Nellari can help establish various types of Trusts so that you can provide your family with the security they need.

Charles can represent trustees who need assistance with fulfilling their duties under the trust. He can also provide legal representation for trust beneficiaries who wish to bring suit for breach of fiduciary duty or other improper conduct by a trustee.

When a person passes away, their assets are distributed according to the probate court process. If there is a will, our office can assist personal representatives of the estate through probate. If there is no will, we can represent the estate itself during probate.

Law Offices of Charles Nellari can provide representation for clients who wish to challenge the validity of a Will due to undue influence, fraud, or lack of capacity on the decedent’s part.
